Land rights and large scale agricultural investments in Ethiopia

Abstract

Die Studie "Landrechte und landwirtschaftliche Großinvestitionen in Äthiopien" behandelt die Spannung zwischen Landrechten und langfristig angelegten landwirtschaftlichen Investitionen. Sie prüft das Recht auf Land, das aus dem Recht auf natürliche Ressourcen, auf angemessene Nahrung und die besondere Beziehung der indigenen Völker zu ihrem Land stammt. Die Studie prüft anwendbare Normen und Grundsätze für verantwortungsvolle landwirtschaftliche Investitionen unter internationalem Recht. Die so entwickelten Prinzipien werden auf den äthiopischen Fall angewendet. Die Studie befasst sich auch mit den Auswirkungen von Investitionsgesetzen und Praktiken zu Landrechten. Die Studie befasst sich weiter mit den Governance-Strukturen und Prozessen großer landwirtschaftlicher Investitionen in Äthiopien. Sie untersucht den Einfluss verantwortungsvollen unternehmerischen Handelns auf maßgebliche langfristige Pachtverträge. Darüber hinaus werden Grundsätze der Umwelt- und Sozialverträglichkeit in der Praxis von landwirtschaftlichen Großinvestitionen geprüft. Die Studie untersucht auch die bestehenden Mechanismen für die Überwachung der Einhaltung der Standards verantwortungsvoller Pachtverträge. Sie schließt mit rechtspolitischen Empfehlungen.

The study entitled “Land Rights and Large Scale Agricultural Investments in Ethiopia” deals with the tension between land rights and large scale agricultural investments. It sets out by scrutinizing the right to land which stems from the right to natural resources, the right to adequate food and the special relationship of indigenous peoples with their land. It also examines applicable standards and principles on responsible agricultural investments under international law. The study shifts attention to the application of the principles so developed in the previous chapters to the Ethiopian case. It looks in to the extent to which the Ethiopian land legislation recognizes legitimate land rights. It also dwells upon the impact of investment laws and practices on land rights. The study goes on to look into the governance structures and processes of large scale agricultural investments in Ethiopia. It also examines the extent to which agreements involving large scale agricultural investments are informed by principles of responsible contracts. Moreover, it applies principles of human rights due diligence and environmental protection to examine the extent to which these are reflected in the practice of large scale agricultural investments. The study also examines existing mechanisms for monitoring the extent to which large scale agricultural investments do not run counter to the land rights of communities and culminates with recommendations.
